Terms and Conditions - Fox IT Training Services
1. Provisional Booking
1.1 Submitting a provisional booking enables you to reserve a place on a course without commitment. In order to secure the booking, Fox IT requires a firm booking to be made within 5 days of submission of the provisional booking or before the first day of the course, whichever is the earlier, otherwise the provisional place on the course shall be released.
1.2 A firm booking may be made by contacting the Fox IT Training Administration Department by telephone on 01483 221280 or via the firm booking facility on the Fox IT web-site.
2. Confirmation of Booking
2.1 Once you have completed the booking details and submitted the form to Fox IT as a firm booking, you shall receive confirmation from Fox IT that your booking has been received. A contract however is only formed at the point at which the Fox IT Training Administration Department informs you of the acceptance of your booking. Fox IT shall use its reasonable endeavours to inform you of acceptance within 5 working days of submission of your firm booking.
2.2 Fox IT reserves the right to cancel or modify a course or module thereof with respect to timing, location or content at any time prior to the commencement of the course without liability. In this event, you shall be offered the opportunity to either attend an alternative course on an alternative date, or to have a refund or a credit note to the value of the fees you have paid for the relevant course.
3. Fees
3.1 The fees payable by you for the course comprise the course fee and where applicable the examination fee.
3.2 The course fee is the fee published on the Fox IT web-site at the date and time of your firm booking or as otherwise agreed in writing.
3.3 The examination fees published on the web-site are set by the examination board. These fees are subject to change and Fox IT reserves the right to pass any such increase in the fees to you but shall use its reasonable endeavours to provide as much notice to you as is possible of any such increase.
3.4 All fees are quoted exclusive of VAT which shall be chargeable in accordance with prevailing legislation. If you believe you are exempt from VAT, please notify Fox IT at the time of making your booking.
4. Payment Terms
4.1 Once your booking has been accepted, you will be invoiced for the fees using the information provided on the booking form.
4.2 Where invoices are to be settled by a company rather than an individual, your company purchase order reference must appear on the booking form.
4.3 Unless otherwise agreed in writing, payment of the course fees must be received within 20 days of the date of invoice or before the commencement date of the course, whichever is the earlier.
4.4 We reserve the right to refuse admission to or provision of the course if payment has not been received in full.
4.5 Where foreign travel is required by Fox IT personnel, or where delegates are travelling to the UK, we reserve the right to demand cleared payment at least 2 weeks before the commencement date of the course before confirming bookings.
5. Payment Methods
5.1 Fox IT accepts payment with the following credit cards:
- MasterCard
- Visa Credit
- Visa Delta
- JCB
- Visa Purchasing
- American Express - subject to addition of 3.5% credit card fee
5.2 Where the course is booked with a company purchase order, payment can also be made by cheque or BACS transfer.
6. Joining Instructions
6.1 Joining instructions will be issued to you in advance of the first day of the course. This shall typically be 10 - 14 days before the first day of the course but may be later if the course is booked at short notice. The joining instructions shall typically include directions to the training venue and details of any pre-course work.
6.2 Delegates may be required to complete a separate Delegate Registration Form on the start date of each course.

7. Cancellations and Transfers
7.1 If you wish to cancel a booking or to transfer the booking to another date please notify the Fox IT Training Department as soon as possible by telephone on +44 (0)1483 221280, by fax on +44 (0)1483 221500 or by e-mail to (training@foxit.net).
7.2 All amendments, including simple amendments to booking details, must be confirmed to Fox IT in writing.
7.3 If you are booking as a consumer, then notwithstanding the provisions of clauses 7.4, 7.5, 7.6 and 7.7, you have by law a right to cancel or transfer your booking within seven working days of making the booking. In such circumstances, Fox IT shall not levy a cancellation charge in respect of the course but shall charge to you any cancellation charges incurred by Fox IT in cancelling examinations.
7.4 No cancellation charge shall apply if Fox IT receives notice of the cancellation of your booking or request to transfer more than twenty (20) working days before the first day of the course.
7.5 If Fox IT receives notice of cancellation of your booking between twenty (20) and ten (10) working days before the first day of the course, then a cancellation charge of 50% of the course fees shall apply.
7.6 If Fox IT receives notice of the cancellation of your booking less than ten (10) working days before the first day of the course, a cancellation charge of 100% of the course fees shall apply.
7.7 Fox IT shall also charge to you any cancellation charges incurred by Fox IT in cancelling examinations, regardless of the notification period.
7.8 Where a booking consists of multiple parts, e.g. the ITIL Managers course consists three elements, Service Delivery, Service Support and Revision Day, then the cancellation of any one of these elements shall be deemed to be the cancellation of the entire booking. For the avoidance of doubt the first day of the booking shall be the first day of the first element of the multiple part course and cancellation charges shall be calculated against the entire course fee as above.
7.9 Where a booking is made as part of a Fox IT Training Passport then the same terms as defined above will apply.
8. Substitutions
8.1 You may substitute an alternative attendee at any time before the first day of the course, subject to the substitute attendee meeting any course entry requirements.
8.2 Where the course materials have already been sent out it is your responsibility to pass them on to the substitute attendee. Please note that it is important that any advance preparation called for in the joining instructions is accomplished by the substitute attendee.
9. Information you provide to us
9.1 Information you provide to us shall be held on our training systems. Fox IT shall not release this information to third parties but may, unless you notify us otherwise, utilise this information in order to send you details of Fox IT services that we consider to be of interest/relevance to you.
10. Delivery of the course
10.1 Fox IT warrants that the course shall be provided with reasonable skill and care and that the instructors used shall be appropriately skilled, trained and qualified. All other warranties are excluded to the extent that such can be excluded by law.
10.2 Please note that, unless agreed otherwise in writing, the course has not been designed to meet your individual requirements and therefore it is your responsibility to ensure that the course meets your requirements and that you satisfy the course entry requirements, e.g. any pre-requisite qualifications.
10.3 Where it is agreed that it is your responsibility to provide training premises and facilities you shall provide Fox IT with reasonable and safe access to such premises and shall ensure that such premises and facilities are appropriate and suitable.
11. Intellectual property rights
11.1 All intellectual property rights in the course materials are vested in, and shall remain at all times vested in, Fox IT or its licensors.
11.2 Upon payment of the course fees, you are granted a licence to use the course materials solely for the purpose of receiving and enjoying the course. You may not reproduce the course materials without the prior written consent of Fox IT.
12. Fox IT Liability
12.1 Fox IT does not exclude or restrict its liability for death or personal injury resulting from its negligence or that of its employees while acting in the course of their employment.
12.2 Subject to clauses 11.1 and 11.3, Fox IT's total aggregate liability for direct loss or damage whether arising from negligence, breach of contract or otherwise shall be limited to the fees paid by you for the course.
12.3 Fox IT shall not be liable for any loss of profits, business or anticipated savings, loss of or damage to data or any indirect or consequential loss or damage whatsoever.
12.4 Fox IT does not accept liability for failures or delays or incidents beyond the reasonable control of Fox IT.
13. Alteration to Terms and Conditions
13.1 Fox IT may amend these terms and conditions at any time by posting the new version on our web site. Notwithstanding the foregoing, the terms and conditions that apply to your booking shall be those in force at the date and time that your booking is accepted.
14. Law
14.1 These terms and conditions are governed by English law and all matters relating to these terms and conditions shall be subject to the jurisdiction of the English courts.
